Deportation and Removal

Annapolis, Maryland, Immigration Attorneys:  Removal and Deportation Defense

Being in removal proceedings in front of an Immigration Judge, often called deportation proceedings, is an intimidating proposition for immigrants and their families.  Each year, many persons are arrested while crossing the border into the United States. Others have Immigration "detainers" placed on them after they are arrested for minor traffic violations or other infractions of state laws and are discovered to have no immigration status. Still others, including lawful permanent residents, face deportation when they are convicted of certain misdemeanors or felony crimes, including crimes involving moral turpitude and/or aggravated felonies.  Once in removal proceedings, an immigrant "respondent" needs the assistance of a skilled immigration lawyer.  Our Annapolis, Maryland immigration law office will fight hard for the immigrant, helping to get the best possible outcome of removal and deportation proceedings.

People often wonder what can be done to fight deportation or removal proceedings. If you are a respondent in removal proceedings, we can help you exercise your rights in defense of deportation and removal. The Department of Justice can often grant relief from removal and deportation, but it takes an experienced immigration attorney to get effective results:

  • Cancellation of removal: For certain permanent residents and nonpermanent residents, removal proceedings can actually be terminated. Depending on the amount of continuous time you have acquired in the United States, and to what degree your deportation would affect a qualifying U.S. citizen, such as your U.S. citizen children or spouse, you may be eligible for cancellation of removal.
  • Withholding of removal: If you are granted withholding of removal, you may retain the same status you had before you were put in deportation proceedings. Immigration Courts consider various factors including a credible fear of persecution in your home country.
  • Adjustment of status to permanent resident: If you meet certain criteria, we may be able to help you have your status adjusted to that of a permanent resident by the immigration courts.
  • Affirmative or Defensive Asylum: If you applied for asylum and your case was subsequently referred to the Immigration Court, you may be able to renew your asylum application. In some circumstances, even though you have not filed an asylum application you may be eligible to do so for the first time during removal and deportation proceedings.  In either case your asylum petition will be adjudicated by the Immigration Judge.

On the other hand, by asking for and receiving certain relief from the immigration courts, you may be irreparably damaging your eligibility to qualify for relief in the future. You may even forfeit your right to appeal. You need to be informed at every step of the removal process.
