Case Successes

Schifanelli & Associates, LLC has acquired a reputation for successful handling of immigration matters on behalf of people from other countries who sought to come to the U.S. to work, join family members, become permanent residents or to become citizens, and for those who are already here, including permanent residents, helping them exercise their rights to avoid deportation and removal, and/or to secure immigration benefits to which they are entitled, including political asylum.

We have successfully handled cases for immigrants seeking relief under the Haitian Immigration Refugee and Immigration Fairness Act, The Cuban Adjustment Act , Section 245(i) of the Immigration and Nationality Act, and other laws that accord rights and relief to immigrants in varying circumstances. Many times these immigrants were already in deportation and removal in the Immigration Court. In other instances, we have assisted permanent residents who applied for naturalization, attended their citizenship interview, and then heard nothing from the Immigration Service for months or even years. Other clients have retained us after their cases had fallen into bureaucratic limbo with no results or had already been denied. In those cases, we have successfully filed federal court actions for Writs of Mandamus to compel the Immigration Service (USCIS) to make a decision on the client's application, or we have filed appeal with the Administrative Appeals Office (AAO) or the Board of Immigration Appeals (BIA).

We have helped attain refugee and asylee status for immigrants fleeing from their home countries, or unable to return to those countries, by helping them demonstrate their credible fear of torture or persecution at the hands of their government or by the hand of groups that their government couldn't control and murdered or maimed with impunity.

For others, including scholars and scientists, we have successfully petitioned for National Interest Waivers, H-1B non-immigrant work visas, and other employment based permanent residency or temporary work status.

Quite often our successes include simply navigating the complex immigration laws and procedures for family members of U.S. citizens or U.S. permanent residents who want only to be reunited with their loved ones.
